How Will Property Be Divided?
This is a major concern for many people going through a divorce, and rightly so. New York utilizes the “equitable distribution” model of property division, which means that property must be divided equitably between the two spouses. This doesn’t always mean a perfectly equal split, however. There may be reasons to award one spouse an unequal share of the marital estate in certain cases.

Do You Need To Have Grounds For Divorce In New York?
Divorce used to only be allowed if one spouse could prove that the other had destroyed the marriage through abandonment, infidelity, cruel and inhumane treatment or some other “grounds” for divorce. This made it harder to get divorced and it automatically created an adversarial process.
In 2010, New York became the last state in America to offer a no-fault divorce option, which means you can get divorced based on irreconcilable differences rather than one spouse’s wrongful act. No-fault divorce can save time and money as well as reduce stress and conflict, and most divorces are now done this way.
